1. ACCEPTANCE OF TERMS

By accessing and using the PicaBot website (picabot.in), downloading our software, or using our services, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree to these terms, please do not use our services.

These terms apply to all visitors, users, customers, and others who access or use our service.

2. DESCRIPTION OF SERVICE

PicaBot provides photobooth software solutions including:

  • Free and Pro versions of photobooth software
  • Cloud-based photo sharing and QR code generation
  • Payment processing integration services
  • Customer support and technical assistance
  • Software updates and maintenance

Our services are designed for commercial and personal photobooth operations.

3. USER ACCOUNTS AND REGISTRATION

ACCOUNT CREATION:

  • You must provide accurate, complete, and current information
  • You are responsible for maintaining account security
  • You must be 18 years or older to create an account
  • One account per person or business entity
  • Business accounts require valid business information

ACCOUNT SECURITY:

  • You are responsible for all activities under your account
  • Notify us immediately of any unauthorized access
  • Use strong passwords and enable two-factor authentication
  • Do not share your account credentials with others

ACCOUNT TERMINATION:

  • We may suspend or terminate accounts for terms violations
  • You may cancel your account at any time
  • Termination does not relieve payment obligations
  • Data may be retained according to our Privacy Policy

4. SUBSCRIPTION SERVICES

SUBSCRIPTION TIERS:

  • FREE: Basic features with limitations
  • PRO: Full features with payment processing
  • PREMIUM: Pro features plus 4K support and priority support
  • ENTERPRISE: Custom solutions with dedicated support

BILLING AND PAYMENTS:

  • Subscriptions are billed in advance on a monthly or annual basis
  • All fees are non-refundable except as required by law
  • Automatic renewal unless cancelled
  • Price changes with 30 days notice
  • Taxes are additional where applicable

DEVICE AUTHORIZATION:

  • Pro subscriptions are limited to one primary device
  • Additional devices require separate licenses
  • Device transfers available with restrictions
  • Unauthorized devices will have limited functionality

5. SOFTWARE LICENSE AND USAGE

SOFTWARE DISTRIBUTION:

  • Software is licensed, not sold
  • Subject to separate Software License Agreement
  • Free version available for download
  • Pro features require active subscription

PERMITTED USES:

  • Commercial and personal photobooth operations
  • Integration with approved payment gateways
  • Customization within license terms
  • Normal business operations

PROHIBITED USES:

  • Reverse engineering or decompilation
  • Redistribution or resale of software
  • Using software for illegal activities
  • Competing directly with PicaBot services
  • Violating intellectual property rights

6. PHOTO UPLOADS AND DATA PROCESSING

PHOTO SHARING SERVICE:

  • Pro users can upload photos for QR code generation
  • Photos are temporarily stored on our servers
  • Sharing links are generated for customer access
  • Photos are subject to content policies

DATA RETENTION:

  • Free users: 30 days retention for shared photos
  • Pro users: 30 days retention for QR code photos
  • Data deletion available upon request
  • Automatic deletion for storage management

CONTENT POLICIES:

  • No illegal, harmful, or offensive content
  • No violation of privacy or intellectual property rights
  • No spam or malicious content
  • Compliance with local laws required

7. PAYMENT PROCESSING

THIRD-PARTY PAYMENT PROCESSORS:

  • Integration with Razorpay, Stripe, PayPal, and others
  • Users responsible for payment processor compliance
  • PicaBot not liable for payment processor issues
  • Users must maintain PCI DSS compliance where required

PAYMENT GATEWAY CREDENTIALS:

  • Users provide their own payment gateway accounts
  • Credentials stored in encrypted form
  • Users responsible for credential security
  • Regular rotation recommended

TRANSACTION PROCESSING:

  • PicaBot facilitates but does not process payments
  • All transactions between users and their customers
  • Users responsible for transaction disputes
  • Chargeback handling is user responsibility

8. INTELLECTUAL PROPERTY

PICABOT INTELLECTUAL PROPERTY:

  • All software, trademarks, and content owned by PicaBot
  • Users granted limited license for intended use only
  • No rights to PicaBot trademarks or branding
  • Copyrights and patents remain with PicaBot

USER CONTENT:

  • Users retain rights to their photos and content
  • Users grant PicaBot license to provide services
  • Users responsible for content legality
  • PicaBot may remove violating content

THIRD-PARTY CONTENT:

  • Respect intellectual property rights of others
  • Users liable for copyright infringement
  • DMCA takedown procedures available
  • Report violations to info@picabot.in

9. PRIVACY AND DATA PROTECTION

DATA COLLECTION:

  • Personal information as described in Privacy Policy
  • Technical data for service improvement
  • Payment information handled by payment processors
  • Photos uploaded for QR code generation

DATA SECURITY:

  • Industry-standard security measures
  • Encryption for sensitive data
  • Regular security audits and updates
  • No guarantee of absolute security

USER RIGHTS:

  • Access to personal data
  • Data correction and deletion requests
  • Opt-out of marketing communications
  • Data portability where applicable

10. DISCLAIMERS AND WARRANTIES

SERVICE AVAILABILITY:

  • Services provided "as is" without warranties
  • No guarantee of uninterrupted service
  • Maintenance and updates may cause downtime
  • Third-party service dependencies

SOFTWARE PERFORMANCE:

  • No warranty for specific business results
  • Compatibility not guaranteed for all systems
  • Regular updates recommended for security
  • Users responsible for proper implementation

11. LIMITATION OF LIABILITY

MAXIMUM LIABILITY:

  • Total liability limited to fees paid in last 3 months
  • For free users, maximum liability of 100 INR
  • No liability for indirect or consequential damages
  • No liability for business interruption or lost profits

EXCLUDED DAMAGES:

  • Data loss or corruption
  • Security breaches or unauthorized access
  • Payment processing failures
  • Third-party service interruptions
  • Customer disputes or legal issues

12. INDEMNIFICATION

USER INDEMNIFICATION:

Users agree to indemnify and hold harmless PicaBot from claims arising from:

  • Use or misuse of our services
  • Violation of these terms
  • Violation of applicable laws or regulations
  • Infringement of intellectual property rights
  • Customer disputes or legal issues
  • Data security incidents at user facilities

13. GOVERNING LAW AND DISPUTES

GOVERNING LAW:

  • Terms governed by laws of India
  • Disputes subject to Indian court jurisdiction
  • English language version controls

DISPUTE RESOLUTION:

  1. Good faith negotiation
  2. Binding arbitration under Indian Arbitration laws
  3. Legal proceedings in competent Indian courts

CLASS ACTION WAIVER:

  • Disputes resolved individually, not as class actions
  • No participation in class action lawsuits
  • Individual arbitration required

14. MODIFICATIONS TO TERMS

TERM UPDATES:

  • Terms may be updated at any time
  • Material changes communicated with 10 days notice
  • Continued use constitutes acceptance
  • Users responsible for reviewing updated terms

NOTIFICATION METHODS:

  • Email notifications to registered users
  • Website announcements

15. TERMINATION

TERMINATION BY PICABOT:

  • Immediate termination for terms violations
  • Termination for non-payment after notice
  • Termination for illegal or harmful activities
  • Termination for security reasons

TERMINATION BY USER:

  • Cancel subscription anytime
  • No refund for prepaid unused periods
  • Post-termination data retention per Privacy Policy

EFFECT OF TERMINATION:

  • Access to services immediately discontinued
  • Data retention according to Privacy Policy
  • Surviving clauses remain in effect
  • Outstanding obligations remain due
